After 18 Years in the United States, Pakistani Man Granted Permanent Resident Status
In 1997, with a tourist visa, Tahir came to the USA, from Pakistan, after graduating from university. Several years later, Immigration put Tahir in removal proceedings in New York City. Before the Immigration Judge, Tahir applied for withholding of removal. In 2004, the Immigration Judge ordered his removal from the USA, but granted him withholding of removal. That order of removal barred Tahir from applying for various forms of relief for ten years.
In 2013, Tahir married a U.S. citizen. His wife and I prepared a visa petition, Form I-130, with a bona fide marital exemption request, which was approved, without an interview, some eight months later. By then, Tahir and his wife had become the parents of a baby girl.
Next, Tahir and I worked together on a proposed joint motion to reopen. We filed it with the office of the DHS attorneys in New York City. The DHS “joined in” the motion, which was then filed, in the form of a motion for reopening and termination of removal proceedings, with the same Immigration Judge who had presided over Tahir’s case ten years earlier. The Immigration Judge granted the motion, which meant that Tahir was then free to file his application for permanent resident status directly with the USCIS. The application is also known as adjustment of status.
Tahir and I prepared his adjustment of status package and then filed it. Eight months later, after several follow up letters, Tahir had his big interview with an Immigration Officer. With his wife and me by his side, Tahir patiently answered all of the Officer’s questions. At the end of the interview, she told Tahir: Everything looks good, but I have to check on a few things. Two months later, the USCIS sent Tahir a notice: Your Application to Adjust Status has been Approved. This afternoon, Tahir received his Permanent Resident card in the mail. His wife and he are very happy.
