Ecuadorian Client Granted Asylum by Immigration Judge
Jose fled persecution, by government officials in Ecuador, four years ago. He entered the USA without inspection, but was apprehended by the Border Patrol almost immediately. Immigration & Customs Enforcement (“ICE”) put him in a detention center. Two weeks later, Jose was interviewed by an Asylum Officer. That Asylum Officer concluded that Jose had a Credible Fear of being persecuted again, should ICE send him back to Ecuador. Jose was released on a low bond. His Immigration Court case was transferred to New York City.
Based on the recommendation of an Ecuadorian friend, Jose made an appointment to come see me. He hired me to represent him before the Immigration Judge. We worked together on his asylum application. One of Jose’s brothers, who was still living in Ecuador, sent me dozens of papers and documents, all in Spanish, which directly supported Jose’s asylum claim. We found a professional to translate all of them. Jose also had a “personal witness,” his mother, a lawful permanent resident of the USA. She was an eyewitness to some of the horror that Jose had experienced in Ecuador.
After a couple of Master Calendar Hearings, the Immigration Judge scheduled us for a final hearing. Jose and I worked together for many hours in preparation for that hearing. I also helped his mother get ready to testify in Immigration Court. The final hearing went well. The judge received all of his papers and documents into evidence. Jose testified for approximately two hours. Both the Immigration Judge and the Department of Homeland Security’s (“DHS”) attorney were impressed with Jose’s straightforward and detailed answers that he gave to the attorneys’ and judge’s questions. The Immigration Judge granted asylum to Jose. The DHS attorney said that she would not appeal. Case over, Jose won.
That decision by the Immigration Judge was given a little over one year ago. Jose recently filed an application to become a Permanent Resident (also known as an application to adjust status). When Jose and I speak, he never fails to tell me how much he loves the United States. He has a good job, is married now, and his wife and he have a two year old daughter.
